1.3 Million Daily CBD Users Could Fail a Drug Test That They Should Pass

Legal CBD products contain trace THC. Current workplace drug tests can't tell the difference. People are losing their jobs for using a legal product. The testing is the problem, not the products.

The Problem

A Legal Product. An Unfair Test.

The science is clear. The system hasn't caught up.

CBD products contain trace THC

Even fully legal UK CBD products (under 0.2% THC) contain enough THC to trigger a positive result on a workplace oral fluid drug test. A 2025 Johns Hopkins study found that 80% of participants tested positive after taking legal CBD oil.

Tests can't distinguish CBD from cannabis

Workplace oral fluid tests detect THC at 2 ng/mL — a threshold so low it catches legal CBD users, passive smoke exposure, and even surface contamination. The test cannot tell whether you used a legal CBD product or smoked cannabis.

People are losing their jobs

Workers who use legal CBD for pain, anxiety, sleep, or recovery are being dismissed for gross misconduct based on positive drug tests. Many are in safety-critical roles where drug testing is mandatory — transport, healthcare, construction, energy.

No UK guidance exists — anywhere

The EWDTS, ACMD, FSA, MHRA, and every UK government body has failed to issue any guidance on CBD and workplace drug testing. The 2 ng/mL cutoff hasn't been reviewed since before the definitive CBD false-positive study was published. There is a total policy vacuum.

It's Not Just These Professions

Any employer can implement drug testing. Retail, hospitality, finance, education, tech. If your contract includes a drug & alcohol policy, you're at risk. The test doesn't know — or care — that CBD is legal. It just flags THC.

Hair Strand Testing — 90 Days, No Escape

Hair strand tests are treated as the gold standard in family courts, custody cases, probation, and high-security workplaces. CBD cross-contamination builds in hair over months — even if you stop using CBD, your hair still carries the THC.

Studies confirm most CBD products are mislabelled — some marketed as "THC-free" still contain THC. You can't trust the label. And the test doesn't care what the label said.

It's Not Just CBD Users

Passive Smoke. Same Positive Test.

You don't have to use CBD — or cannabis — to fail a workplace drug test. Just being near someone who smokes cannabis can push you over the threshold.

Our Demands

Three Changes. Millions Protected.

Review the Cutoff

The EWDTS and UK laboratories must urgently review the 2 ng/mL THC confirmation cutoff in light of the Vikingsson (2025) findings. The current threshold cannot distinguish between legal CBD use and cannabis consumption.

Issue Guidance

The UK government must issue formal guidance to employers, employees, and testing laboratories on CBD products and workplace drug testing. Workers deserve clarity before their careers are ended.

Protect Workers

Employers should be required to consider CBD use as a legitimate explanation for a positive THC result before taking disciplinary action. No worker should lose their livelihood for using a legal product.
