1.3 Million Daily CBD Users Could Fail a Drug Test That They Should Pass
Legal CBD products contain trace THC. Current workplace drug tests can't tell the difference. People are losing their jobs for using a legal product. The testing is the problem, not the products.

A Legal Product. An Unfair Test.
The science is clear. The system hasn't caught up.
CBD products contain trace THC
Even fully legal UK CBD products (under 0.2% THC) contain enough THC to trigger a positive result on a workplace oral fluid drug test. A 2025 Johns Hopkins study found that 80% of participants tested positive after taking legal CBD oil.
Tests can't distinguish CBD from cannabis
Workplace oral fluid tests detect THC at 2 ng/mL â a threshold so low it catches legal CBD users, passive smoke exposure, and even surface contamination. The test cannot tell whether you used a legal CBD product or smoked cannabis.
People are losing their jobs
Workers who use legal CBD for pain, anxiety, sleep, or recovery are being dismissed for gross misconduct based on positive drug tests. Many are in safety-critical roles where drug testing is mandatory â transport, healthcare, construction, energy.
No UK guidance exists â anywhere
The EWDTS, ACMD, FSA, MHRA, and every UK government body has failed to issue any guidance on CBD and workplace drug testing. The 2 ng/mL cutoff hasn't been reviewed since before the definitive CBD false-positive study was published. There is a total policy vacuum.
This Affects You
You Could Be Fired for Doing Nothing Illegal
If your workplace drug tests, legal CBD can end your career. These are just some of the professions where people are at risk â right now.
Police
Mandatory oral fluid testing. Legal CBD = positive result = career over.
UK Police ForcesFire Service
Safety-critical role. Random drug testing standard. CBD users at risk of dismissal.
Fire & RescueParamedics
NHS ambulance trusts enforce zero-tolerance drug policies. CBD triggers the same test.
Ambulance ServiceBritish Army
Compulsory Drug Testing programme. Positive test = administrative discharge. No distinction for CBD.
Armed ForcesRoyal Air Force
CDT applies to all ranks. Legal CBD oil can end a career in minutes.
Armed ForcesRoyal Navy
Zero tolerance. Oral fluid and urine testing. CBD users treated identical to cannabis users.
Armed ForcesRoyal Marines
Commando-trained, zero tolerance tested. Years of distinguished service lost over a legal supplement.
Armed ForcesRail Workers
Network Rail & TOCs enforce EWDTS standards. Train drivers, signallers, track workers â all tested.
TransportHGV / Bus Drivers
DVSA roadside testing. Professional drivers using CBD for focus or pain face licence loss.
TransportConstruction
CSCS & major contractors require pre-employment & random testing. Labourers to site managers.
Safety-CriticalEnergy & Nuclear
ONR-regulated sites. The most stringent testing regime in UK workplaces. CBD = fail.
Safety-CriticalNHS & Healthcare
Nurses, doctors, care workers. Trusted with lives, penalised for a legal product.
HealthcarePrison & Probation Officers
HMPPS staff subject to testing. Officers using CBD for stress face the same sanction as drug use.
Public SectorMerchant Navy
MCA-regulated seafarers tested under international maritime drug standards. CBD not exempt.
TransportAviation & Pilots
CAA random testing. Cabin crew and pilots held to strictest standards â CBD triggers failure.
TransportOil & Gas
Offshore workers tested pre-mobilisation. A positive from CBD means no platform access â no pay.
Safety-CriticalPrisoners & Inmates
Mandatory drug testing in custody. A positive from legal CBD = loss of privileges, extended sentences, segregation.
Justice SystemPeople on Probation
Court-ordered drug testing. A positive result from CBD can mean breach of licence and recall to prison.
Justice SystemFamily & Child Access
Hair strand tests are the gold standard in family courts. CBD cross-contamination builds over months â and can cost you access to your children.
Justice SystemIt's Not Just These Professions
Any employer can implement drug testing. Retail, hospitality, finance, education, tech. If your contract includes a drug & alcohol policy, you're at risk. The test doesn't know â or care â that CBD is legal. It just flags THC.
Hair Strand Testing â 90 Days, No Escape
Hair strand tests are treated as the gold standard in family courts, custody cases, probation, and high-security workplaces. CBD cross-contamination builds in hair over months â even if you stop using CBD, your hair still carries the THC.
Studies confirm most CBD products are mislabelled â some marketed as "THC-free" still contain THC. You can't trust the label. And the test doesn't care what the label said.

Passive Smoke. Same Positive Test.
You don't have to use CBD â or cannabis â to fail a workplace drug test. Just being near someone who smokes cannabis can push you over the threshold.
Non-smokers spent 3 hours near cannabis smoke and 70% exceeded the 2 ng/mL workplace cutoff. They never touched cannabis.

Millions more live with them â partners, housemates, children. None of them chose to use cannabis, but all could fail a workplace drug test.

THC Detection: CBD vs Passive vs Active Cannabis

Three Changes. Millions Protected.
Review the Cutoff
The EWDTS and UK laboratories must urgently review the 2 ng/mL THC confirmation cutoff in light of the Vikingsson (2025) findings. The current threshold cannot distinguish between legal CBD use and cannabis consumption.
Issue Guidance
The UK government must issue formal guidance to employers, employees, and testing laboratories on CBD products and workplace drug testing. Workers deserve clarity before their careers are ended.
Protect Workers
Employers should be required to consider CBD use as a legitimate explanation for a positive THC result before taking disciplinary action. No worker should lose their livelihood for using a legal product.
